Clinic Practice: MacArthur Justice

Roderick MacArthur Justice Center Criminal Justice Reform Clinic—Bowman/Van Brunt Section

The Roderick MacArthur Justice Center offers two clinical sections, one taught by Professors Locke Bowman and Alexa Van Brunt and the other by Professor Joe Margulies.

The Bowman/Van Brunt Section is focused on the litigation of complex civil rights cases and other advocacy projects relating to the improvement of the Illinois criminal justice system. Students working with Mr. Bowman and Ms. Van Brunt will be assigned to one or more case teams. The students on each team will collaborate as junior counsel with Professor Bowman in the litigation of a pending case. The docket of cases varies over time. During the 2011-12 academic year, Mr. Bowman, Ms. Van Brunt and their students will be handling several cases, including matters involving the use of torture by police officers under the command of Jon Burge to extract confessions and cases in which wrongfully accused persons are suing police for damages for the consequences of the false charges. Students' work will vary depending upon their level of commitment and energy and the demands of the particular litigation. Typically, students research and draft pleadings and legal memoranda, including briefs to trial and appellate courts; assist with and/or conduct formal and informal discovery; and assist in the in-court presentation of evidence and argument. This course aims to provide students an opportunity to apply the principles they have learned in the classroom in a concrete procedural context where they and an experienced attorney attempt to use the law to achieve a goal. It is hoped that students in the course will face and address issues of professional responsibility in a real life context; that they will reflect upon the connection between their practice and their personal values; and that they will begin to learn how to be effective colleagues.


Roderick MacArthur Justice Center Criminal Justice Reform Clinic—Margulies Section

Students in the Margulies section work on strategic thinking in complex criminal-justice litigation. Among other clients, Margulies represents so-called “high-value detainees” at Guantanamo and death row inmates. Students in the clinic are treated as co-counsel. While the subject of the litigation and identity of the client varies over time, the constant that unifies the clinical experience is the need to develop creative strategies for advancing the interests of unpopular clients in a hostile legal, political, and public environment. Margulies does not accept second-semester 3Ls who have not previously been one of his clinic students.
