Clinic Practice: Undocumented Youth Defense An increasing number of undocumented youth are apprehended by Immigration and Customs Enforcement because of contact with the criminal justice system. Once these children are placed in deportation proceedings, they are not afforded an attorney at the expense of the government. The Office of Refugee Resettlement ¿ the federal agency charged with detaining unaccompanied minors ¿ has a secure detention facility in Chicago that holds undocumented children who have been arrested, adjudicated delinquent, or have had behavioral issues at other detention facilities. Some have valid asylum claims; many have families here. In addition to their undocumented status, these adolescents¿ cases are especially complex because of their contact with the criminal justice system. Students enrolled in this clinical course will learn about the intersection between immigration and criminal law. Students will represent these children as they seek asylum, Special Immigrant Juvenile Status, or other forms of immigration relief. Students may also defend non-citizen youth in juvenile court. This clinical course will provide the opportunity to interview clients, draft memoranda of law and affidavits, and appear in court ¿ both immigration court and the Cook County Juvenile Court. Students do not need a 711 license to appear in Immigration Court. In addition to client representation, students will present ¿Know Your Rights¿ workshops at local Chicago high schools. These street law presentations offer information to non-citizen students about the immigration consequences of criminal activity.
The class is currently scheduled for Fridays at 12:00 p.m. Upon agreement by the entire class and the instructor, the class could be changed to a different day and time.
This clinic section will provide students with an opportunity to represent children charged with crimes in both juvenile and criminal court. Covering every aspect of juvenile defense work, this section will allow students to develop investigation and trial skills, learn first hand about the criminal justice system and take an active role in court proceedings. The section will also provide many opportunities for client interaction. PLEASE NOTE THAT THIS COURSE DESCRIPTION DIFFERS FROM THE ORIGINAL LISTING AND THAT THIS CLASS WILL NO LONGER INVOLVE ANY IMMIGRATION WORK.
