The Law of Real Estate Development and Finance

This course will explore a range of issues affecting the development, financing and management of real estate in the United States. The course will consist of class lecture and discussion, as well draw on a range of guest speakers with direct experience in different areas of real estate law and business. Topics to be studied include: (1) land assembly for development, including the use of emnent domain; (2) tax increment financing and other federal, state and local subsidfies; (3) mortgages, including lender commitments and the current foreclosure crisis; (4) the interplay of partnership, corporate, bankruptcy, and tax law with real estate development; (5) zoning issues, including variances, code amendments and planned unit developments; (6) issues in the interpretation and enmforcement of commerical and non-commercial leases; (7) special statutory and constitutional limits regarding the zoning of religious institutions; (8) conservation easments and historic preservation or landmark designations (9) the effect of environmental laws on real estate development, including due diligence related to hazardous substance contamination; (10) green building regulations and certifications; and (11) incentives and requirements for the development of affordable housing. The grade will be determined on the basis of a group project write-up and presentation and a take-home written examination. There are no prerequisites for the course.
