Advanced Estates and Trusts

This course will be a continuation of the basic trusts and estates course. Among the subjects to be covered are discretionary trusts, powers of appointment, future interests, the rule against perpetuities, the duties of trustees, the powers of trustees, and the liability of trustees. Attention will be given to the drafting of wills and trusts as well as tax and nontax planning with trusts. Evaluation: Will and trust drafting assignments comprise 40% of the grade and a final examination comprises 60%. All students will complete the final examination. With Professor permission, students additionally write a one-draft paper which partially would meet the Law School graduation writing requirement. Teaching method: Lecture and discussion Texts: Dukeminier, Johanson, Lindgren and Sitkoff, Wills, Trusts, and Estates, 7th ed. Prerequisites: Estates and Trusts
