First Amendment [Executive LLM] A close study of the constitutional protection of free expression and religion. Both speech and religion present some similar problems. What is being protected, and why is it singled out for protection? What degree of protection should be given to either religion or speech in light of countervailing governmental interests? With respect to free speech, we will examine such doctrinal issues as advocacy of unlawful conduct, defamation of public officials, commercial speech, obscenity, speech in the public forum, symbolic conduct, rights of association, campaign finance regulation, and regulation of broadcasting and the internet. With respect to religion, we will consider limits on government's ability to fund religious activities and rights to religious exemptions from generally applicable laws.
