Case Details

Luis Kevin Rojas was an eighteen-year-old high school student when he was arrested for murder. Luis went to dinner in Greenwich Village, New York City with a friend, and was boarding a public train after two in the morning when he was arrested by public transportation officers, who then radioed for NYPD. The shooting for which Luis and his friend were detained occured at approximately 2:07 A.M. Police found a .22 caliber bullet in Luis's jacket pocket, which Luis said was a souvenir he found. The bullets used in the shooting were .32 caliber, but the prosecution introduced the bullet as evidence anyway. There was no physical evidence linking Luis to the crime. Eyewitness misidentification and an inept defense attorney led to Luis's imprisonment until the State Supreme Court acquitted Luis in 1998.
