Electronic Data Discovery Panel
In December 2006, a package of amendments to the Federal Rules of Civil Procedure are expected to take effect, addressing the controversial area of "electronic discovery." Some welcome the changes. Some claim they restrict the scope of discovery. Some say they do not go far enough. Some say they are unnecessary. And some say the proposed amendments violate the Rules Enabling Act. Judging from the range of reactions, the Civil Rules Advisory Committee must have gotten it right. Its work is already being cited as persuasive authority in federal district court decisions nationwide.

Conventional wisdom holds that, if the recording industry is going to sue anyone, it should focus on high volume up-loaders and avoid minors, the elderly, the poor and other sympathetic targets. This wisdom is wrong on all counts. Rather than trying to close down p2p file sharing sites altogether, the recording industry should target the marginal file sharer in an effort to make legal music downloads seem like better value for money.

The eBay case: Should nearly automatic injunctive relief be granted to patentees who only license inventions? Or, should a compulsory license be granted to infringers against "non-working" patentees?
