Law and Regulatory Policy along the Frontier

How does regulation account for new issues and emerging technologies? This has always been a conundrum for lawmakers and agency officials – and, because of their crucial role in overseeing regulatory decision-making as part of their constitutional law, administrative law, and statutory interpretation responsibilities, the judiciary as well. In this course, we will consider the question of regulatory strategy and legal technique by focusing on a few especially subjects of regulation that meet my definition of “frontier” subjects. They include: artificial intelligence/machine learning, drug policy include cannabis, psychedelics, & opioids), public health emergencies stemming from novel viruses, such as Covid-19, and new ways of furnishing legal services, including by non-lawyers. Recommended Pre-req: Administrative Law or Legislation may be helpful, but are not required.
