Constitutional Controversy in the Public Arena

To live in America today is to be surrounded by public constitutional debate, with advocates battling on social media and television, in editorial pages, and on the streets. This course examines the public persuasion dimensions of an eclectic series of constitutional controversies throughout the American experience. Fusing legal history, rhetorical analysis, and constitutional law, we will assess the arguments advanced by key public advocates, the oft-innovative methods they employed, their success or failure with vital audiences, and constitutional understandings left in their wake. In the process, we will draw lessons for effective contemporary public constitutional advocacy.
