Patent Law
This course is designed to make Patent Law accessible to students of all backgrounds, from the liberal arts to the hard sciences. The course will first explore the normative justifications for protecting intellectual property generally, and for patents in particular. Then it will address the core legal rules of Patent Law, beginning with Patent Law's process-oriented disclosure requirements; continuing with the substance-oriented requirements of novelty, non-obviousness, and utility; and ending with debates about the subject matter eligible for patent protection. The course will next examine patent enforcement, including infringement and remedies. Finally, the course will explore appellate practice before the United States Court of Appeals for the Federal Circuit and the complex choice of law problems that are presented by this national appellate forum for patent cases.
